Three Senate HOA Bills, Two from Horry County
State senators prefiled three other HOA bills. None is comprehensive enough, however, to address the state’s need for protecting homeowners living under developer control in an HOA-governed community. Each bill appears to target one or more HOA problems in each senator’s own district.

- S.82: This bill would offer training (optional for interested parties) in HOA management and give magistrate courts jurisdiction in certain HOA disputes (if claims do not exceed $7,500). Senator Greg Hembree (District 28, Dillon and Horry counties) submitted the bill.
- S.122: It requires the South Carolina Real Estate Commission to offer an online HOA course for interested persons and gives magistrates jurisdiction in minor HOA disputes ($7,500 claims or less). Senator Darrell Jackson (District 21, Richland County) submitted the bill.
- S.104: This bill also would give magistrate courts jurisdiction in minor HOA disputes ($7,500 claims or less). The bill also authorizes the State Attorney General to investigate HOA complaints and requires disclosure of certain documents to buyers. The bill was submitted by Senator Luke Rankin (Chairman, Senate Judiciary Committee, District 33, Horry County.)
